Two boda boda riders were on Wednesday, January 4 charged with robbery with violence over an incident that led to the death of a police constable on December 24, 2022.

Appearing before Milimani Law Courts Senior Principal Magistrate Esther Kimilu on Wednesday, January 4, the suspects were charged with violently robbing a woman of her mobile phone while armed.

This decision was reached after viewing CCTV footage retrieved from the scene of the crime along Muchai Drive near Bently Club within Kilimani in Nairobi County.

State prosecutor Anne Munyua revealed, “Police have finalised their investigations although they are still pursuing other members of the notorious gang.”

Munyua urged the court to detain the suspects for 10 days.

“Police are through with their investigations and now the two may be charged while police pursue other members of the gang that has been terrorising the public within the Kilimani area,” Munyua stated.

Earlier, the police had alleged that the police constable was lynched by an angry mob on Christmas eve after they allegedly accosted a woman along Muchai Drive in Kilimani, robbing her of her mobile phone and other assorted items.

The police constable succumbed to injuries sustained after being attacked by an angry mob.

However, the family rejected the security agencies’ claim and insisted that their relative was killed by police, citing conflicting reports on the crime and the results of the postmortem examination.

“My brother was arrested by the police at 9 pm on December 24 in the Kilimani area on a motorcycle with his friends,

"As a uniformed officer, he did not flee but instead identified himself to them," a family member revealed.

The deceased sister decried the manner in which his brother was alleged to be part of the gang by the police.

“How can a dead man killed by mob injustice go to a police station and record a statement?” she continued.

“He had a pistol, so how come he didn’t shoot anyone when he realised his life was in danger? The police have already classified him as a robber,” she added.

According to the Directorate of Criminal Investigations (DCI), the deceased died as a result of a mob attack after residents cornered him following a robbery mission.

According to the DCI, the constable was armed with a pistol loaded with 15 bullets and was part of a three-man gang that accosted a woman along Muchai Drive in Kilimani and robbed her.
