Viral Sim Swap Suspect Released After Spending One Week in Remand

The suspected sim Swap fraud syndicate, David Mutai, was released on Friday, January 6, on a cash bail of Ksh300,000. 

Mutai, arrested on December 30 in connection with a series of syndicates, pleaded not guilty to the charges levelled against him before a Kiambu Court. 

The suspect was interrogated for more than seven days as detectives tried to establish his connection with the swindling cases.

The Sim Cards fraud is a widely used tactic by Con gangs in Nairobi.

On Monday, January 2, Mutai's lawyers accused the police of torturing him in the process of questioning. 

The lawyers who spoke to the press claimed that the officers deprived Mulot of food and attempted to him out of legal representation. 

"It is two days now since my client had any food which is against the law and basic human rights," the lawyer stated.

Mutai was later presented to the Kiambu court on Tuesday, January 4, where  Chief Magistrate Meresia Opondo ordered his detention for two more days. 

The prosecution had prayed to detain him for seven days as detectives tried to maximize the evidence needed to prove their case. 

The former convict was accused of being the gang leader of a group that siphoned Ksh941,000 from a bank account belonging to a legislator from Rift Valley, who was out of the country on official duties between December 2 and 3, 2022. 

According to a statement from the Directorate of Criminal Investigations, investigations by detectives based at the elite Crime Research & Intelligence Bureau unravelled his identity. They alleged that he was the leader of the gang.

The DCI noted that the gang was notorious for hacking mobile phones and accessing details of bank accounts belonging to unsuspecting customers. 

Two other suspects alleged to be part of the gang that siphoned money from the MP's account had been arrested in an earlier raid.
