First Hurdle for Office of Mudavadi's Wife as LSK Issues Ultimatum to PSC

Prime Cabinet Secretary Musalia Mudavadi is staring at the first hurdle barely a week after he presided over the launch of the Office of the Spouse of the Prime CS. 

The Law Society of Kenya (LSK) threatened to go to court within seven days to challenge the legality of the office if the Public Service Commission (PSC) fails to provide information. 

In a letter seen by Kenyans.co.ke dated Tuesday, February 28 to the PSC, the LSK indicated that it would move to court if the commission does not publish the legal framework and financial implications of the said office.

"Pursuant to Article 234 of the Constitution, the Public Service Commission may establish an office in the public service, subject to compliance with the obligation imposed on it by Section 27 of the Public Service Commission Act.

"Further, we note that the Prime Cabinet Secretary is among the Cabinet Secretaries appointed pursuant to Article 152 of the Constitution," the letter signed by LSK President Eric Theuri read in part. 

Apart from the legal framework and financial implications of the Office of the Spouse of the Prime CS, LSK also asked the PSC to provide information on the benefits that shall accrue to the members of the public as a result of the establishment of the office. 

"Please note that we shall be constrained to move to Court and challenge the establishment of the office if the information sought above is not made available upon the expiry of the period set out above," the letter concluded. 

Speaking to Kenyans.co.ke, Theuri noted that the Society will not hesitate to move to court if their demands to the PSC are not met. 

"We have given them the letter and they now have seven days to respond, failure to which we shall proceed to court," Theuri indicated. 

The Prime CS on February 24 joined his wife, Tessie, at the Movenpick Hotel in Nairobi to launch the now controversial office.

During the launch, Mudavadi indicated that Tessie’s office was established to complement the work done by the Office of First Lady Rachel Ruto.

Furthermore, the Prime CS indicated that his wife's office will complement the work done by the office of the spouse of the Deputy President, Dorcas Rigathi.

The establishment of the office sparked mixed reactions with some Kenyans questioning its  relevance.
