Rally driver Maxine Wahome on Tuesday, March 21, claimed that the late Asad Khan exploited her at his death.

Through her lawyer, Senior Counsel Phillip Murgor, she claimed that Asad had claimed Ksh2.6 million in payments for repairs on her rally car, which she had not authorised.

Murgor presented correspondence between Wahome's and Ashad's lawyers and claimed that the deceased withheld the accused's car, demanding payments.

"The car was scheduled to be sold this year, and no work was required on it. There is no outstanding bill amounting to Ksh2,594,792 owed to your client as all payments were settled and all records of this are available," Murgor, Wahome's lawyers and former Director of Public Prosecution, stated.

The letter dated February 23 from Chege Kariuki and Associates admitted that Wahome only owed the deceased Ksh760,000, which her sponsors would pay.

In response, Asad's lawyers dismissed claims that spare parts were removed from the vehicle and insisted that the Ksh2.6 million was not paid.

"It was the late Asad who began to strip the car for rebuild for this year's rally. We trust that the amount shall be settled prior to the release of the motor vehicle," read the letter by Andrew and Steve Advocates.

Nonetheless, Murgor countered back, alleging that the late Asad exploited his client.

He claimed that Asad and his brother Adil Khan allegedly pocketed money from Maxine's sponsorship deals.

 "Those sponsorships went straight to Asad and his brother Adil and as she stands here, she does not have anything in her pocket and very little in her bank account,” he stated,

Asad was said to have convinced Wahome to quit her career as a nursery school teacher, then at the age of 22 years. However, she reportedly jumped into an abusive relationship, and Murgor argued that she should be released as she was a victim of domestic violence.

He justified her decision to flee from the crime scene and not visiting her ex-spouse in the hospital, explaining that she did not want to confront his family.

Murgor, on behalf of Wahome's lawyers, added that the accused had demonstrated a willingness to attend the trial and abide by all conditions to be set if released on bond or bail. 

However, the judge, Justice Lilian Mutende, ordered that Maxine remain in custody to enable the court to receive a pre-bail report on Friday, March 24. The case, she added will be mentioned on Monday, March 27 to confirm compliance and the ruling date. 

Asad passed away in December 2022, with his lawyers accusing Maxine of assault and murder. Her lawyers, however, argued that the rally driver died of self-inflicted injuries as the pair argued on the balcony.
