Rally driver Maxine Wahome's lawyer, Senior Counsel Phillip Murgor, on Friday, March 31 announced plans to review his client's case with the Director of Public Prosecutions (DPP) Noordin Haji.
In a statement, the lawyer noted that he will write to the DPP to recall the police file and review the evidence arising out of the investigations against her client.
"We are certain he will agree with us that the late Asad Khan was the sole author of the injuries that caused his hospitalisation," read the statement in part.
Murgor further emphasised that there was no evidence to sustain any charge against Maxine implicating her in the murder of the late rally driver Asad Khan.
He also reiterated that the cause of Khan's death was septicemia which was caused by drug-resistant, hospital-acquired bacteria as revealed by the forensic post-mortem examination.
Wahome was released on bail from the Langata Women's Prison and was accompanied by her mother who could not hide her joy.
The rally driver was accused of injuring Khan, who was her boyfriend, on December 12, 2022, after an argument in their Nairobi apartment.
Khan was found in a pool of blood on the stairs before he was taken to the hospital for emergency medical attention. He later succumbed to the injuries.
His family called for justice with his brother noting that Khan trained Wahome in her career and catapulted her to stardom.
However, Wahome denied all charges against her arguing that Khan was a violent partner and she only acted in self-defense.
Her lawyer also accused the deceased and his brother of exploiting Wahome and pocketing her sponsorship deals.
"Those sponsorships went straight to Asad and his brother Adil and as she stands here, she does not have anything in her pocket and very little in her bank account,” he stated.
