The Magistrate Court at the Jomo Kenyatta International Airport (JKIA) on Thursday declined to grant bail to Nancy Kigunzu, also known as 'Mathe wa Ngara', after multiple case postponements.
The denial of bail came after the prosecution submitted that the suspect posed a significant risk of fleeing.
Speaking to Kenyans.co.ke, Kigunzu's lawyer, Danstan Omari, revealed that the defense team intends to challenge the court's decision to deny their client bail.
"We will be seeking a review of the ruling on our bail application so that another court could issue a second opinion," Omari revealed.
Kigunzu had earlier asked to be released on bail citing her deteriorating medical condition. Kigunzu told the court that she suffers from anxiety.
Further, reports also indicated that the Assets Recovery Agency (ARA) had obtained orders from the High Court to freeze the cash seized from her house.
The order will remain in effect for 90 days.
While appearing in court on Monday, the accused questioned where the money seized from her house was being held. Her attorneys led by Omari observed that the money was supposed to be deposited at the Central Bank of Kenya in line with the court's orders.
“The money was recovered from the respondent (Nancy), and the state needs to convey to the respondent the issue of where that money is," her lawyer stated.
Omari also told the court that the money was supposed to be held separately as an exhibit.
Kigunzu was arrested on August 21, days after police raided her house in Ngara and recovered drugs and Ksh13.4 million hidden in sacks. The suspect is accused alongside two minors.
She has been arraigned in court several times and in the last session, which was attributed to her medical condition.
