Police Announce Mass Auction of Detained Motorbikes

Bondo Police Station has obtained a court order authorising it to dispose of 42 motorbikes stored at the facility for years. 

In a statement which was published in the Gazette Notice released on Friday, September 8, the station warned the owners of the motorbikes that they risked losing their property should they fail to pick them up within 30 days.

In partnership with a local auctioneering company, the owners of the 42 motorbikes were asked to fetch them before the ultimatum lapses. 

"Notice is given pursuant to the Disposal of Uncollected Goods Act of (Cap. 38) laws of Kenya and the Authority of the court Siting in Bondo law court under CR. Misc Appl No E96B/2023 to the owner/custodians of motorcycles lying idle unclaimed within Bondo Police Station yard are informed to collect them within thirty (30) days from the date of this publication," the Gazette notice read in part.

The police station also informed the owners of the motorbikes that they would carter for the cost of the publication of the notice in the Gazette and other storage expenditures. 

"Failure to which the auctioneers have been authorised to sell them through public auction without any other notice nor reference to the owner," the station warned. 

Police cited The Auctioneers Act, which stipulates the code of conduct for auctioneers, the procedures for conducting auctions, and the parties' rights.

In the event the owners fail to turn up, in accordance with the provisions of the law, the auction will be conducted in public, and the highest bidder will be allowed to buy the motorbikes.

The buyer will have to pay the purchase price in full at the time of the auction. Sometimes, a buyer is allowed to deposit part of the money before the auction. 

The money collected from the auctioning exercise will be remitted to the State through the National Treasury, which will, in turn, designate it as part of the expenditure.  

A buyer is also allowed to seek services from a lawyer to avoid legal challenges often witnessed in such business dealings.

The Auctioneers Act permits a buyer to initiate an ownership transfer immediately after purchasing a property.
