Court Freezes Ksh 643M Wealth After Govt Employee on Ksh 55K Salary Fails to Explain

The High Court on Wednesday froze assets worth Ksh643 million belonging to a City Hall employee after he failed to explain the origin of the wealth.

Court documents filed by the Ethics and Anti-Corruption Commission (EACC) seeking forfeiture of the property showed that the suspect's acquisition was disproportionate with his monthly net earnings of Ksh55,866.

Initially, EACC had poked holes on how the employee amassed the properties, which included high-end cars and parcels of land, in a span of just five years between January 1, 2016 and October 31, 2022.

The Commission, as a result, filed a suit in November 2022 seeking the freezing of the suspect's bank accounts and other assets to allow for investigations.

After investigations were completed, the employee was tasked to explain the source of the wealth but could not accurately account for it.

According to court filings obtained by Kenyans.co.ke, EACC then moved to court seeking forfeiture of the wealth.

In the application, the complainant demanded that the six respondents, including the City Hall employee, be prohibited from withdrawing, transferring, disposing, wasting or dealing with funds contained in 12 bank accounts.

Other properties earmarked for repossession are four high-end vehicles including a Land Cruiser valued at Ksh7 million, Toyota Alphard (Ksh2 million), and two Mercedes-Benz worth Ksh3.1 million and Ksh3.4 million. 

Also on EACC radar are four parcels of land in Busia, Naivasha and Kahawa Downs valued at Ksh21.34 million.

The High Court granted the preserve orders on Wednesday and the case is scheduled for mention on September 27, 2023.
