Makadara Member of Parliament has been acquitted of all possible charges relating to taking part in illegal protest and planning unlawful assembly, as earlier claimed by the State. 

The High Court sitting in Nairobi on Tuesday, September 26, also freed Orange Democratic Movement's Members of County Assembly, Peter Imatwok and Moses Ogeto with whom Aladwa was accused.

Consequently, the Judge ordered the State to return the cash bail which the ODM Party politicians had deposited for their freedom.

Aladwa's Lawyer, Bryan Khaemba noted that the accusations levelled against his client were defective from the very beginning.

"The file was marked as closed and cash bail to be refunded," Khaemba stated in a letter sent to the Makadara Member of Parliament.

On July 22, in a statement to the press, the Office Inspector General of Police directed the ODM politicians to surrender themselves to the nearest police station and face charges of taking part in illegal protest and planning an unlawful assembly.

The statement from the Office Inspector General of Police prompted the ODM Party Nairobi chairman George Aladwa, MCAs Peter Imwatok and Moses Ogeto to rush to court and secure anticipatory bail on July 24, to block their arrest and detention.

As a result, Justice Diana Kavedza ordered the Inspector General of Police and Directorate of Criminal Investigations to restrain their junior officers from arresting the three pending the hearing and determination of the matter.

However, Justice Kavedza allowed both IG Japhet Koome and DCI Amin Mohammed to summon the ODM Party politicians in relation to any criminal conduct.

"That for the avoidance of doubt, the respondents are at liberty to investigate or charge the applicant for any Criminal Conduct.

"However, they shall not arrest them (unless the applicants fail to honour their summons) and they shall not detain them until further orders of the court," reads the court documents," the Judge ordered.

The Azimio coalition has since suspended the protests, and is currently locked in Bipartisan Talks with the ruling Kenya Kwanza Coalition to find a solution to the political impasse.
