Govt Adds 23 Land Owners and Removes 25 Others in SGR Compensation Deal

The National Lands Commission (NLC) on behalf of the Kenya Railways Corporation (KRC) has listed 23 more landowners whose parcels of land were used for development projects and are set for compensation.

In a notice, NLC revealed that 23 parcels of land were used for the construction of the Nairobi-Naivasha Standard Gauge Railway (SGR) project (phase 2A).

All affected landowners were urged to seek compensation from the government with the State expected to announce a date when this will be done in due course.

During the application, each person will be required to deliver a copy of their identity card, personal identification number, land ownership documents and bank account details.

"Further inquiries to hearing of claims to compensation for interest parties in the land required for the project shall be held on the dates and places announced," read part of the notice.

The land parcels in question are located in; Ngong, Kitengela, Kajiado and Suswa. The parcels range from 0.6 acres to 5.8 acres.

NLC also expunged over 25 land parcels from the list of properties lined up to benefit from project compensation. NLC is also set to review another list of 20 parcels of land also scheduled to benefit from the project.

Per the Land Act 2012, both the national and county governments may acquire land after filing an application with the NLC.

"If, after the land has been compulsorily acquired the public purpose or interest justifying the compulsory acquisition fails or ceases, the Commission may offer the original owners or their successors in title pre-emptive rights to re-acquire the land, upon restitution to the acquiring authority the full amount paid as compensation," reads part of the act.

The Nairobi-Naivasha SGR was launched in 2019 by former President Uhuru Kenyatta. The Ksh150 billion project features the longest tunnel in East Africa which is also ranked as the second longest in Africa.

Operations in the Nairobi-Naivasha stretch began in 2017. The line cuts across Nairobi, Kajiado, Nakuru and Narok and features four passenger stations including at Ongata Rongai, Ngong, Mai Mahiu and Suswa.

The construction was delayed after the government failed to secure funding. 

By the time of its launch, the government had spent Ksh17.6 billion on compensation. Some of the affected families will be compensated using 4,000 acres of land hived off Kedong Ranch.
