KNEC Offers Students With Cancelled Exams Opportunity to Appeal

Students who had their national exams cancelled have been given a chance to appeal by the Kenya National Examinations Council (KNEC). 

This is captured in the  Kenya National Examinations Council (Amendment) Bill, 2024 that was prepared by the Presidential Working Party on Education Reforms.

According to the Bill, aggrieved students will be allowed to appeal the cancellation 30 days after results are published.

“A candidate whose examination results have been cancelled may apply to the Council within thirty days after the release of the results for a review of the Council's decision,” the Bill reads in part.

While in the past students had to use the judicial system to seek redress, going forward, KNEC will accept requests from aggrieved candidates which must be made in writing. 

The students must expressly indicate why they are seeking a review. 

“The Council shall upon receiving an application, consider the application and respond, in writing, to the applicant within thirty days,” the Bill further reads.

Students will be accorded the courtesy of being told why their request for review was rejected by the Council.

If the request for review is successful, the student will receive communication of the decision in writing.

Additionally, KNEC will require the applicant to appear before the council within 90 days after the successful application for review. 

“Where the Council is satisfied that the candidate has not been involved in any examination irregularities, the Council shall release the results to the candidate,” the Bill proposes. 

The Bill is currently being subjected to public participation before being presented to Parliament for debate.
