Foreign Affairs PS Explains Why Kenya Won't Join South Africa Hague Case

Kenya will not join South Africa in a case filed at the International Court of Justice in the Hague, Netherlands which condemns Israel in the ongoing conflict in the Middle East. 

This was communicated by the Foreign Affairs Principal Secretary Korir Sing’oei on Monday, March 4, during the EU-Kenya Strategic Dialogue and Partnership meeting. 

Sing’oei noted that Kenya’s position was that the issue in Israel and Palestine did not need a court of justice intervention. 

“Part of the reasons why Kenya did not enjoin in the proceedings at the court of justice initiated by South Africa and a couple of other countries is because it is our very strong view that this is not a matter that can be litigated,” the PS stated.

He explained that there were no courts equipped to make substantive pronouncements on the complex challenges occurring in Palestine and Israel.

Kenya's foreign policy stance on the matter is that the two parties should seek an amicable solution to resolve the conflict.

“The view that we continue to hold is that ultimately there has to be a negotiated settlement and there cannot be better negotiation than a two-state solution,” Singo’ei stated. 

The PS further added that Kenya would continue standing firm on its foreign policy regarding conflicts in other nations.

“We do not keep changing our positions. Whether in the case of the Ukraine invasion or whether on the matter of Somalia and Somaliland, or Ethiopia,” he spoke of the Kenya Kwanza administration’s foreign policy. 

“Our position is anchored on the fact that territorial integrity is sacrosanct.”

Speaking of Haiti, Sing’oei remarked that Kenya was monitoring the situation in the Caribbean country and would honour its commitment to help the war-torn country. 

On Friday, March 1, Kenya officially committed to deploying 1,000 policemen to Haiti.
