Court Orders Arrest of Kenya Medical Practitioners, Pharmacists and Dentists Union (KMPDU) Officials

A warrant of arrest has been issued against officials of the Kenya Medical Practitioners, Pharmacists and Dentists Union (KMPDU).

The court on Tuesday directed that the officials be apprehended for failing to appear in court to answer to contempt charges.

In the ruling made by Employment and Labour Relations Court Judge Wasilwa Hellen, the Kilimani OCS was ordered to ensure that the officials were apprehended, noting that the ongoing strike the KMPDU officials are leading is unlawful.

"The court cannot do anything else if the officials refuse to appear in court when required," Judge Wasilwa said.

Following the order, medical practitioners took to the streets picketing outside the Ministry of Health offices at Afya House.

"Haturudi kazi, tunaenda jela (We are not going back to work, We will go to jail)," they shouted.

In December last year, the court had stated that the industrial action was illegal and called on the medics to carry out negotiations with the Government.

On Monday, Health Cabinet Secretary Cleopa Mailu and the Council of Governors (CoG) gave the striking doctors up to Wednesday to return to work, failure to which they will face the sack.

Meru Governor Peter Munya, who is the CoG Chairman, noted that disciplinary action would be taken against those who do not report to work.

"We have made a decision; those who don't resume work will face disciplinary action from Wednesday this week. They will get show-cause letters by the respective counties. The counties will have no option but to implement the employment regulations and dismiss them," Munya said.

The strike is on its 37th day.
