Court Quashes 2017 Ballot Paper Tender

The CORD coalition has recorded a major win in a case contesting a Sh2.5 Billion tender for the printing of ballot papers to be used in the upcoming August elections.

The High Court on Monday quashed the tender issued by the Independent Electoral and Boundaries Commission (IEBC) to a Dubai-based firm.

While delivering the ruling, High Court Judge George Odunga cited irregularities as the reason for the cancellation.

The IEBC will now have to start the bidding process afresh as per the judge's orders despite the little time remaining before the August 8 General Election.

In December 2016, Odunga gave a temporary order suspending the execution of the printing tender given to Al Ghuraiar Printing and Publishing Company until the case filed by CORD was heard and determined.

He observed that the issue was of national interest and asked the Coalition to publish his orders on national newspapers.

At the time, CORD through its lawyer James Orengo had argued that the contract awarded to the Dubai company was illegal and unconstitutional.

The Siaya Senator maintained that the opposition's intention was not to delay the upcoming polls but noted that specifications for poll registers, ballot papers, result declaration forms as contained in the tender documents were not in conformity with requirements of the electoral laws which establishes an electronic voting system.
