A defamation suit filed by former Devolution CS Anne Waiguru against National Super Alliance (NASA) flag-bearer Raila Odinga, has taken a new twist after he accused her of refusing to respond to lifestyle queries.
In a response filed at the Milimani High court, Mr Odinga stated that Ms Waiguru had refused to respond to 15 lifestyle audit questions that would enable him to defend himself in the defamation suit.
"I will be greatly prejudiced if these interrogatory questions are not answered as I will not be in a position to sufficiently prepare for trial," revealed Odinga.
Odinga said that the former CS had refused to answer questions on her basic salary, the list of properties she owns, including houses and cars and their worth.
He added that he wanted Waiguru to declare the amount of allowances she earned monthly, whether she traded in the Nairobi Stock Exchange while she was a Cabinet Secretary and a list of her dependents and the amount of money she spent on each of them.
The Orange Democratic Movement (ODM) party leader argued that the questions Waiguru had refused to respond would have enabled him adequately defend himself in the defamation suit.
Waiguru, however, accused Odinga of embarking on a fishing expedition and was employing tactics to stall the suit as the 15 questions did not relate to issues raised in the defamation suit.
The former CS had sued Raila Odinga for allegedly portraying her as a woman of low moral standing, who was involved in unethical and professional misconduct at the National Youth Service (NYS) by engaging in corruption.
"He portrayed me as a woman of low moral standing, who is involved in unethical and professional misconduct," said the former CS.
