Girl Found With Bhang to Sue Govt For Sh5 Million

The high school student whose indecent photo was taken by police officers after she was arrested with possession of bhang will sue the state for Sh5 million.

The girl's lawyers said that the way the student was indecently treated and exposed on social media has grievously affected her and her family and are now seeking compensation.

The lawyers said that they will also file a petition against the Inspector General (IG) and the Director of Public Prosecutions (DPP) for the way she was treated during and after her arrest.

Gladys Wamaitha, one of her lawyers said that the Inspector General of Police is responsible for how suspects are handled after arrest and the conduct of police officers.

She wants the court to order the DPP to publish regulations governing the way suspects who are female students are treated.

The girl was among other 40 students who were arrested after they were found drinking, smoking and having sex in a bus.

The girl landed in more trouble when she was found hiding bhang in her privates.

Her arrest, however, caused public uproar when an indecent photo of her, taken at the police station surfaced online.

In the photo in which her face is shown, she is see without her undergarments, with a female police officer standing next to her.

The girl was sentenced to 18 months probation, and was required to see a probation officer once every month during the period of the probation.

After the ruling, her lawyer said she would contest the sentence.

Speaking in Nairobi today, the lawyers said that alongside the compensation claim, they will seek to have the sentence quashed.

They also want the court to expunge her records.
