A Kwale Court on Thursday ordered for the arrest of Chief Government Pathologist Johansen Oduor for neglecting summons and failing to attend court sessions.
Dr Oduor, a key witness in the case involving a British soldier, Sergeant Major John Bob Marley, who died on April 26 2013 at a Diani hotel, has caused major delays on the case.
Resident Magistrate Christine Njagi directed the prosecution to ensure that Oduor appeared before the court, to present the postmortem report on what caused the death of Sgt Marley.
Marley mysteriously died in the company of two other soldiers, Sgt Steve Gillian and Sgt Chris Woods, in a hotel room at Diani Marine Divers Village where the three were residing.
“I was in the bathroom. I heard him (Bob) scream and I ran to see him lying on the floor. At the same time, Sgt Chris Woods who was in the room moved close to touch Bob but he got an electric shock. I pulled the lamp plug off the wall and rolled him off the lamp,” Nation quoted Sgt Gillian.
Sgt Gillian told the court that Marley was breathing when he was found on the floor but succumbed on arrival at Diani Hospital.
