The High Court has dismissed a request to bar the IEBC from gazetting Mombasa Governor Ali Hassan Joho as an aspirant in the August 8 General Election due to his academic qualifications.
Making the ruling on Wednesday, Justice Chacha Mwita declared that the IEBC was the only body which could determine the qualification of the Governor.
Justice Chacha was ruling on a petition filed by a Nairobi resident identified as Abdalla Juma who sought to have the IEBC compelled to reject Joho's degree which he claimed had been acquired fraudulently.
The court directed the petitioner to serve those affected by the case and appear before it on May 3 during which more directions regarding the matter would be issued.
On Tuesday, Juma filed the case seeking to block Joho from defending his gubernatorial seat.
Through his lawyer, Kiharu MP Irungu Kang'ata, Juma argued that the ODM deputy leader did not possess a genuine degree, therefore, he didn't qualify to be a governor.
This followed Joho's admission that he attained a D- in his KCSE sparking questions on how he gained entry at the University of Nairobi (UoN).
