High Court Orders Gays and Lesbians be Given Due Recognition

The High Court has ordered the NGOs Recognition Board to accept an application it had earlier rejected concerning the formation of an NGO for gays and lesbians in Kenya.

Judges Issac Lenaola, Mumbi Ngugi and George Odunga based argued that the constitution allows the recognition and protection of all Kenyans regardless of their sexual orientation.

National Gay and Lesbian Human Rights Commission Executive Director Eric Gitari had moved to the High Court after the NGOs Coordination Board rejected his application to form a lobby group on grounds that it would be a front to protect gays and lesbians.

The judges however said that the board had failed to accord just and fair treatment to gays and lesbians in the country by denying them freedom to form an association.

Activists seeking to register the lobby group say its core objective is the advancement of human rights, more specifically, to address violence and human rights abuses against gays and lesbians.
