Kenya Broadcasting Corporation Case Against Mombasa Governor Ali Hassan Joho Withdrawn

Kenya Broadcasting Corporation (KBC) has withdrawn its contempt of court case against Mombasa Governor Ali Hassan Joho and two others following an agreement by the involved parties.

KBC had sued the Governor, Mombasa County Secretary Francis Thoya and Lands executive Anthony Njaramba for defying a court order that had barred the county administration from demolishing a wall around 22 acres of land in Bombolulu.

The court had ordered the state corporation to fence the land as the rightful owner was determined but county workers demolished the wall claiming that the court order had not been presented to them.

The state broadcaster, however, yesterday withdrew the case after an agreement by all parties involved to focus on the main application which concerns ownership of the land in question.

"We want the main application to be heard to determine who is the owner of the plot in question," explained Joho's lawyer, Lucy Momanyi.

KBC claimed ownership of the plot while the Governor claimed that part of the land had been sold to the former municipal council. 

Joho added that there were some outstanding rates KBC ought to have paid first.
