Kidero's Government Sued Over Sh10 Billion

Makadara Member of Parliament has sued the Nairobi County Government for failing to follow due procedure when handling Sh10 Billion in public funds. 

Benson Mutura, told the High Court on Friday that Evans Kidero's Government spent Billions in two years, without the approval of the Controller of Budget, Agnes Odhiambo.

“In each of the two financial years over Sh10 Billion have been spent at source and without approval of the Controller. This non-compliance with the law is a sure recipe for corruption,” read the affidavit he filed in the High Court.

The MP challenged that the Controller of Budget was aware of the illegal happening, but chose to ignore instead of reporting the matter to the Ethics and Anti-Corruption Commission (EACC).

“She was duty bound to inform the people of Nairobi that over the last two financial years over half of each of the total budget has been spent without her approval. Her failure to do so amounts to acquiescence in and condonation of the transgressions of the county,” he said in his application.

He also requested the court to compel EACC, to establish whether the Nairobi Government had used its revenue to conduct corrupt businesses, citing inconsistency in its operations. 

Also in his affidavit, the complainant further urged the High Court to bar Kidero's Government from spending any more funds before obtaining the necessary approvals.

“Pending the hearing and determination of this Application/Petition a conservatory order of injunction be issued to restrain the county from depositing any of the revenue, money raised or received by or on behalf of the County Government of Nairobi in any bank account besides the account for the County Revenue Fund established under Article 207 of the Constitution,” Mutura applied.
