Members of County Assembly (MCAs) will now earn full salaries until March 2018 and not August 2017 as expected.
The High Court, on Thursday, ruled that the current constitution entitles MCAs to a five-year term which expires in March 2018.
Justice Chacha Mwita, while delivering his ruling in the case filed by two members of the County Assembly Forum, Andrew Kiplimo Sang and Richard Ouma, underscored that the Ward Representatives had a right to their salary until March as it was their constitutional right.
"In the law, the five-year term for current MCAs comes to an end in March and as such, they are entitled to salary until that time," Chacha stated.
The county legislators through the Assembly Forum chairperson Nahu Nassir had earlier indicated that they would not vacate office until 2018 when their term elapses.
“Any electoral commission that holds elections for MCAs next year will be doing so in vain. Those elected next year will have to wait until we complete our term,” Nassir said.
The 47 counties in the country have approximately 2, 526 county assembly members who earn Sh165,00 per month.
The ruling if not challenged will see taxpayers chuck an extra Sh2.9 Billion to pay the Representatives from August 2017 to March 2018.
