Muthama's Lawyers Claim State Planning to Send Him Back to Jail

Machakos Senator Johnson Muthama’s lawyers have alleged that the State is secretly plotting to send him back to the Pangani cells where he had been jailed last year.

Muthama’s team of veteran lawyers, who include John Khaminwa, James Orengo, Jully Aulo, Harun Ndubi and Antony Oluoch claimed that the State had orchestrated the removal of two prosecutors working on the case to ensure the senator is sent back to jail.

“A prosecutor is supposed to aid the court to arrive at a fair decision and not to secure a conviction. The withdrawal of the two competent prosecutors leaves a lot to be desired.

"This court was determined to finalise this 2015 case today (Friday)," Khaminwa decried.

He added that other leaders charged with incitement had all been released; they are MPs Moses Kuria (Gatundu South), Ferdinand Waititu (Kabete) and Kiambu Governor William Kabogo.

Muthama was charged alongside activist Japheth Muroko.

They have both denied inciting Kenyans to "ouster the government of President Uhuru Kenyatta for allegedly failing to increase salaries of teachers and for oppression".

The case was adjourned to November 8 and 9, to allow the new prosecutors to familiarize themselves with the case.
