Presidential Results Announced at Constituency Level will be Final - Court Rules

The High Court has declared that the Presidential election results announced at the constituency level will be final and not subject to any alterations.

Making the ruling on Friday, the three-judge bench noted that returning officers had the authority to announce the final results for every particular constituency without the results being altered at the national tallying centre.

The judges were making their pronouncement on a case challenging a section of the Election Act which gave the IEBC the mandate to vary results announced at constituency level.

They further ruled that anyone who wished to have the numbers announced by the returning officers altered would have to seek the permission of the court through an election petition.

The judges further ruled that the law allowing the polls body to make any changes to the results at the national tallying centres was consequently null and void.

The case had been filed by three Kenyans including UN special rapporteur Maina Kiai, Tirop Kitur and Khelef Khalifa.

IEBC has insisted that it is the only body mandated to announce results and declare winners, especially for the presidential post.

However, the Opposition declared that it would set up a parallel tallying centres to compile results from their agents who will be deployed at the constituency level.
