A Mombasa Court on Monday ruled to dissolve a marriage in which a petitioner, among other complaints, told the court that she had never had conjugal relations with her husband since they got married.
In her ruling, Justice Martha Koome said that she found the marriage broken given that both parties in the case were not even able to communicate.
In the woman's divorce suit, she claimed that her husband was impotent hence unable to grant her conjugal rights since they got married in 2011 till 2014, when she filed the case seeking termination of their marriage.
The petitioner told the court that even during their wedding night her husband could not engage her in sexual intercourse.
She went ahead to support her claim with a gynaecological report that was presented to the judge which confirmed that her hymen was still intact.
The wife also complained that the husband mistreated her since she could not bare him a child. She further alleged that the husband was adulterous and had moved in with another woman whom he said had bore him a child.
In his defense, the husband who did not refute the accusations told the court that he did not wish to live with his spouse because he did not know how she lived when she was in the United Kindom for six years.
According to a Standard report, after their union, the couple lived in Mombasa before the wife relocated to the UK the same year upon getting a job there.
Reports indicate that divorce rate in Kenya is on the rise with a case of this nature being handled in court every single day. This year alone, records at Milimani Court show a total of 123 cases up from 101 in the whole year 2001.
