Mention of NASA's Presidential Petition Kicks Off at Supreme Court

The mention of the presidential petition filed by the National Super Alliance (NASA) at the Supreme court has kicked off.

The parties involved who include the President Uhuru Kenyatta, the Independent Electoral and Boundaries Commission (IEBC), IEBC Chairman Wafula Chebukati, and NASA have appeared before Supreme Court Registrar Esther Nyaiyaki.

The parties were all been directed to file their list of contested and non-contested issues.

The Jubilee Party says it has five issues for determination, NASA has listed 28 issues to be addressed by the court while IEBC has two.

According to IEBC's Lawyer Paul Muite, the electoral body's issues include whether Uhuru Kenyatta was validly elected and declared the winner and the reliefs to be granted by the Supreme Court.

Some of the issues that NASA has listed include; whether IEBC had received all forms 34A, 34B and 34C before announcing the final presidential results.

The Opposition also wants to know whether IEBC in any manner changed, altered or adjusted any of the prescribed forms 34A, 34B and 34C during or subsequent to the elections date.

NASA further questions if IEBC Chairman Wafula Chebukati's act of declaring President Kenyatta as the winner of the 2017 presidential elections violated the provision of Articles 1, 38, 81 and 138 (4) of the Constitution and is, therefore, null and void.

They also want to know whether IEBC, Mr Chebulati, Kenyatta or their agents or employees committed any malpractices, misconduct, corruption actions, irregularity, acts of intimidation, improper influence or other actions or omissions contrary to election law.

NASA has also enquired on the exact number of the rejected votes in the 2017 presidential elections.

The lawyers present included Ken Ogeto, Ahmednasir Abdullahi and Fred Ngatia representing President Kenyatta, Paul Muite, Kamau Karori and Paul Nyamodi representing IEBC and Jackson Awele and Peter Kaluma representing NASA leader Raila Odinga.

Security has been beefed up around the Supreme Court ahead of the pre-trial conference which will start on Saturday 7 pm.

Major roads in the city including City Hall Way, Wabera Street and Taifa road have been shut down to ensure that the case will proceed without any external interference from the public.

These roads will be blocked to motorists and pedestrians from Saturday to Tuesday and on Friday next week.

Judiciary Chief Registrar Anne Amadi divulged that special badges have been prepared to be issued to those wishing to access the court premises.
