DCJ Philomena Mwilu's Arrest Sparks Wave of Tension Among JSC Members

Chief Justice David Maraga on Thursday morning called for an urgent Judicial Service Commission meeting to discuss the events that rocked the body.

JSC members revealed that the meeting sought to discuss the legality of Deputy CJ Philomena Mwilu’s arrest, procedures that should be followed in pursuing a case against a sitting judge and the commission’s role in the process.

Mwilu was present in the meeting which required six members for a quorum in accordance with the law.

The DCJ is yet to take a plea after the High Court on Wednesday temporarily stopped the criminal proceedings against her.

Justice Mwilu was arrested on Tuesday afternoon and charged over cases of corruption, abuse of office, failure to pay tax and improper dealings with Imperial Bank.

The judge had been under investigation for months after being reported by the KRA to the DPP over the suspicious transfer of large amounts of money in and out of several bank accounts.

Her arrest drew mixed reactions from the public with a section terming it a political move by the government.

Lawyer Edwin Sifuna, who is the ODM secretary general, questioned whether politics may have played a part on her arrest.

“The long winding statement he [the DPP] gave justifying his action against the DCJ did not inspire much confidence. He must now speedily conclude this prosecution, remembering always that Kenyans shall not forgive him should this turn out to be a politically instigated witch-hunt,” remarked Sifuna.

The sitting judge was part of the Supreme Court bench that nullified President Uhuru Kenyatta’s win after during the 2017 General Election.
