Blunder Police Made After Arresting Senator Malala

Kakamega Senator Cleophas Malala, who was arrested on Friday in relation to the Matungu killings, has cited mischief in the charges that were preferred against him.

The senator, who has since threatened to sue Interior Cabinet Secretary Fred Matiang'i and Inspector General of police Hilary Mutyambai questioned the charges written on the OB and what authorities plan to charge him with.

 “How can I be booked on incitement to violence charge in the OB, yet they plan to charge me with murder?” he inquired.

The senator cited that he would sue the two authorities over unlawful detention.

Malala, who was set free on Sunday after intervention by the Director of Public Prosecutions Noordin Haji, had been arrested and detained over the weekend in relation to the Matungu killings.

In a statement used by the DPP, he stated that the investigations were at an advanced state but not complete.

“The evidence so far gathered does not meet the requisite threshold. In the meantime, I further direct that the suspects be released on P52 pending the said investigations and report back to police on Monday, May 20th at 10.00am without fail,” stated Haji.

Malala was apprehended at Sovereign Hotel, Kisumu, in what appeared to be an ambush as he left his phone behind.

Others arrested on Friday were former Sports Cabinet Secretary Rashid Echesa and Mayoni Ward Representative Libinus Oduori.

Matungu MP Justus Murunga presented himself to detectives at the Western region police headquarters in Kakamega.

The four were set to be arraigned in court on Monday.
