Widow Parades Bishop in Court Over Ksh200M Property Fight

A widow, on Monday, October 12, presented a bishop and two other people in court as witnesses during the hearing of a Ksh200 million property case.

A report by Daily Nation indicated that the widow, Norah Atieno, is fighting to prove to court that she got married to the late businessman Eliakim Olweny as a second wife.

Olweny passed away in 2016 and owned multiple properties across the country including Evans Sunrise Hospitals.

The bishop, Tobias Nyarath, an Assistant Chief and Atieno's cousin appeared at the Nakuru Court as witnesses in an attempt to prove Atieno's claim of marriage to the deceased through Luo customs.

She argued that 12 heads of cattle and Ksh160,000 was paid to her parents as dowry, proving that she was legally married to Olweny.

The cousin was the first to testify noting that he was sent to deliver four cows in 1993 at which point he also handed her parents an envelop containing Ksh40,000.

"My cousin instructed me to take four cows to Ms Atieno's home in Asembo, Siaya, during our first visit," he told the court.

He further noted that they returned to Asembo the same year to pay the bride price that included eight cows and Ksh120,000 which was given to her father.

Taking the stand, Nyarath, who heads Nomiya Church, confirmed that he prayed and gave spiritual advice at the event.

Atieno is embroiled in a succession suit against two other women, Phelesia Akoth and Ann Wanjiru, who disclosed that they were married to the tycoon.

Wanjiru and Atieno claimed that there was a plan to lock them out of the inheritance.

It was earlier claimed that Olweny had married Akoth in 1966 in a monogamous Christian wedding that did not permit him to tie other knots before a divorce was finalised.

The sons to the deceased tycoon were also enjoined in the case and wanted to know the legal status of Ms Atieno and Ms Wanjiru to sue as widows.
