The Supreme Court dismissed the election petition filed by Martha Karua to challenge the election of Governor Anne Waiguru.
The five-judge bench led by Deputy Chief Justice Philomena Mwilu dismissed all the litigations of the National Rainbow Collision (NARC) Party Leader against the Kirinyaga Governor.
The court determined that all election matters within Kenyan courts were concluded in the Supreme Court judgement on August 6, 2019.
Waiguru had moved to the Supreme Court to challenge the Court of Appeal's decision to move Karua's election petition to the High Court for hearing even after it had been dismissed.
The court also ruled that each party shall bear its own costs incurred in the hearing of the cases in the Supreme Court and the Court of Appeal.
On August 7, 2019, the Supreme Court dismissed Karua's election petition stating that her petition was filed outside the stipulated time frame for filing election petitions. Karua accused the country's top court of denying her justice.
A High Court in Kerugoya threw out her petition on grounds that she had not provided sufficient evidence to back up her claims.
Karua made bribery allegations in Kirinyaga County polling stations which she argued affected the outcome of the gubernatorial election.
In November 2020, the Senior Council was awarded Ksh2.7 million in damages by the East African Court of Justice. Karua had sued the government in relation to the Kirinyaga Elections.
Governor Ann Waiguru was impeached by Members of the Kirinyaga County Assembly (MCAs) on June 9, 2021, on grounds of violation of the constitution, abuse of office and gross misconduct.
Her impeachment was however reversed by an 11-member senate committee who found the accusations unsubstantiated.
The governor previously dismissed claims that she would be a running mate to a presidential candidate in 2022. However, on July 7, she stated that she will be defending her seat as Kirinyaga Governor.
