Kenyans Can Arrest Kinoti-Havi

The President of the Law Society of Kenya (LSK), Nelson Havi, on Monday, September 22, revealed that Kenyans can arrest the Directorate of Criminal Investigations (DCI) boss, George Kinoti.

Speaking during an interview with a local radio station, Havi stated that Kinoti was not a suspect but a convict who was illegally walking free. 

Havi explained that Kenyans can arrest Kinoti should the police fail to arrest him, or he does not avail himself at the Kamiti Maximum Prison to serve a four-month jail term within seven days after the court issued his arrest warrant.

"If he does not submit himself to the Kamiti Maximum Prison, if the Inspector General (IG) Mutyambai does not arrest him after seven days, Kenyans have the authority to arrest him and take him to Kamiti," he stated.

Kinoti was sentenced to prison by High Court Judge, Anthony Mrima on Thursday, November 18, for contempt of court. The Judge found him guilty of contempt after failing to return a weapon confiscated from Nairobi businessman, Jimi Wanjigi.

Justice Mrima further issued warrants of arrest against the DCI boss, and directed the Inspector General of Police Hillary Mutyambai to enforce them. Kinoti was also ordered to submit himself to the correctional facility.

Havi added that Kinoti has not right whatsoever to defy the court order. He added that all leaders, including President Uhuru Kenyatta, should always abide by the law and respect court orders.

During the interview, Havi also explained why he represented embattled Football Kenya Federation (FKF) President, Nick Mwendwa in court. 

Havi stated that he is a lawyer by profession and has the right to represent anyone who sought his services in court. He added that Mwendwa was a client who was being frustrated by people who tried to unlawfully remove him from his elective position.

"I am a lawyer, and my role is to defend anyone in court. Even if the devil is taken to court, I have a right to defend him," he stated.

Havi was part of a battery of high-profile lawyers including veteran John Khaminwa, Prof Tom Ojienda and Senator Mutula Kilonzo who represented the ousted FKF president in court. The court freed Mwendwa on a Ksh7 million bond and gave DCI seven days to present any evidence they had against him.
