Embattled Football Kenya Federation (FKF) boss Nick Mwendwa has alleged foul play over his arrests in the recent past.
Through his lawyer, former Law Society of Kenya (LSK) boss Eric Mutua, Mwendwa wrote a letter to Inspector General Hillary Mutyambai, protesting what he termed as unlawful detention.
"We shall hold you and all concerned officers individually and or personally liable for the false imprisonment, unlawful confinement, abuse of police powers, abuse of office and violation of his rights," part of the letter stated.
Mwendwa's defence team also stated that the FKF boss is yet to officially record a statement despite spending the weekend in custody. This raises questions as to what file will be used when he is arraigned in court on Monday, November 29.
Further, reports revealed that the Office of the Director of Public Prosecution (ODPP) is yet to receive a file regarding Mwendwa's case.
The suspended FKF boss is likely to face two charges against him: failure to account for Ksh29 million said to be missing in FKF accounts and misappropriation of Ksh8.5 million funds.
Mwendwa was arrested again on Friday, November 26, mid-morning in Ridgeways, Nairobi by detectives drawn from the Directorate of Criminal Investigations (DCI) before he was taken to the DCI Headquarters on Kiambu Road for grilling.
This came after a court ruling delivered on Thursday, November 25, that saw the government close his file- which was allowed by senior resident magistrate Wandia Nyamu. Further, the court ordered the cash bail of Ksh4 million to be refunded to him.
"I therefore order this matter closed as prayed by the DPP, " Wandia stated.
Prior to that, his team had been disbanded by Sports Cabinet Secretary, Amina Mohammed, who formed a caretaker committee to run football affairs in the country for the next six months.
Mwendwa was initially arrested at Safari Park hotel on the afternoon of Friday, November 12, after he went to the hotel to pay a courtesy call to the Harambee Stars team that had just jetted in from Kampala, Uganda.
