3 Businessmen Charged for Alleged Ksh350 Million NSSF Land Fraud

Three businessmen were arraigned in a Nairobi Court on Monday following an alleged ploy to defraud the National Social Security Fund (NSSF) of a piece of land

In a court session, the three were accused of allegedly attempting to defraud Ksh350 million by claiming land ownership.

The three businessmen, who are members of the same family, however, failed to take a plea on the case after their lawyer produced stay orders barring them from being prosecuted.

It was revealed that the land in contention was also embroiled in another court case within the Court of Appeal.

Consequently, the three alleged that the court case instituted against them was in a bid to intimidate them from pursuing the other case.

Further, their lawyer alleged that the case fronted by the State was an attempt to utilize state power to harass his clients.

“This court is the only recourse to the accused persons against the historical exercise of state power by an overzealous DPP and DCI against innocent persons,” stated their lawyer.

The three businessman case joins the pile-up of land cases surrounding the Pension Fund.

In a different court case implicating the pensions fund, NSSF lost a Ksh 2 billion case against the government after the fund failed to produce title deeds for 13 pieces of land.

According to the Judge, the pieces of land in the Mlolongo area were purchased fraudulently as one of them was indicated to be in the middle of the road.

Additionally, the judge cited that the purchase was made from a second owner days after they purchased the land from its initial owner.

However, the pensions fund alleged that the purchase made in 1995 was legitimate.
