The High Court has ordered the Acting Inspector General of Police Gilbert Masengeli to appear in court in person at 3pm over the disappearance of two siblings and an activist in Kitengela Town, two weeks ago.
The court's directive comes after the three were reportedly abducted in Kitengela by people believed to be police officers on August 19,2024.
Among the arrested was Bob Njagi an activist, the other two were Jamil and Aslay Longton who are siblings.
The activist was reportedly apprehended while onboard a Kitengela-bound matatu which is said to have bene intercepted by 3 hooded men who forcibly ejected him, bundled him into their vehicle before driving away.
A lobby group would subsequently move to court to compel the police to release the victims or present them to court.
Instructively, The High Court had on August 23, 2024 issued a directive to the Directorate of Criminal Investigations (DCI) and the National Police Service (NPS) to immediately reveal the victims' whereabouts.
In his ruling, the judge directed the top police bosses to do as ordered and produce the missing individuals by August 26, 2024.
"That pending the hearing and determination of this application interpartes an order is hereby issued directing the respondents (DCI and NPS) to immediately disclose the whereabouts of the 2nd to 4th Petitioners to the 1st Petitioner," read the directive in part.
The three were arrested after they came out to protest the arrest of Safina Party leader and businessman Jimmy Wanjigi, who was at the time accused of funding Gen Z protests against the Finance Bill, 2024.
The victims' families had petitioned President William Ruto to help them secure the release of their loved ones in line with promises he made before ascending to office.
“We request the president to keep his promise during campaigns that no one will be abducted or assassinated under his rule when elected,” stated Abdulrazak Longton, brother to Jamil and Aslam.
On Friday August 30, the Law Society of Kenya (LSK) issued a stern statement directing the implicated security agencies to release the victims failure to which it would seek legal redress.
“The LSK demands the immediate production of Mr Bob Micheni Njagi, Mr Jamil Longton, and Mr Aslam Longton by the Inspector General of Police; thorough investigations on the ongoing abductions; and immediate action to deter any further abductions as we shall not sit back and allow the country to fall back to the dark days politically sanctioned killings and disappearances,” LSK President Faith Odhiambo stated.
However, the police did not respond or issue a statement on the victims whereabouts.
