Woman Who Beat Up Kenyan Employee While at Work Charged

A woman of Asian descent was arraigned before the Makadara Law Courts on charges of assaulting a Kenyan man at a workplace in Nairobi

The court heard that the suspect, together with others not present, unlawfully assaulted and inflicted bodily harm on the victim, contrary to Section 251 of the Penal Code.

The incident allegedly took place on June 13 at a kitchen outlet, where the assault occurred. Details surrounding the incident include claims that the suspect engaged in a physical altercation, resulting in injuries to the victim.

The complainant informed the magistrate that his life was in danger, alleging that a witness in the case had been compromised in an attempt to obstruct justice.

Principal Magistrate Irene Gichobi directed the Corporal from Embakasi Police Station to ensure the remaining witnesses are brought before the court to expedite the conclusion of the hearing.

The corporal was also instructed to present the police file to facilitate the rendering of the final judgment.

In Kenya, assault is defined under the Penal Code as causing physical harm to another person. Depending on factors such as the severity of the injuries inflicted, intent, and premeditation, charges can range from simple assault to more serious offences like aggravated assault.

The case will be mentioned on February 12, 2025, as specifics, including the nature of the assault and any potential motives or circumstances leading up to the incident, are still under investigation.

The legal proceedings will involve examining evidence from both the prosecution and defence, including witness testimonies and any documentation of injuries sustained.

Magistrate Gichobi further advised the victim following the ruling, hinting at the possibility of alternative dispute resolution (ADR).

“Some battles are well left unfought and you move on with life, that is one golden rule about life. When you fight all battles you lose many, and you become bitter and vain sometimes it’s good to move on with life,” she advised.

So far three witnesses have testified in the case. The case may also spark discussions about broader social issues such as violence and discrimination within communities.
