The Director of Public Prosecutions (DPP) has urged the Kahawa Law Courts to convict and sentence two individuals linked to the 2019 Dusit D2 terror attack.
In submissions filed at the court on Thursday, the DPP argued that the prosecution had proven its case beyond a reasonable doubt.
The two are jointly charged with conspiracy to commit an offence contrary to section 23(2) as read with section 23(4) of the Prevention of Terrorism Act, Cap 59B (POTA), and committing a terrorist act contrary to section 4(2) of POTA, according to the DPP.
Additionally, they face an extra charge of facilitating a terrorist act and fourteen counts of the same offence.
The charges stem from the heinous terrorist attack on the Dusit D2 Hotel Complex on January 15, 2019, where four armed assailants and a suicide bomber claimed the lives of 21 innocent people and left several others with life-threatening injuries.
During the trial, the prosecution presented evidence through 45 witnesses while seeking to have the two convicted for their offences.
On January 21, Justice Kavedza ruled that two suspects linked to the January 15, 2019, Dusit D2 terrorist attack had a case to answer.
Delivering her ruling virtually, the judge noted that the evidence presented in court established sufficient grounds to place the two suspects on their defence in connection with the attack, which left 21 people dead and several others injured.
''Having considered the evidence of 55 witnesses, including expert testimonies, and the material presented before me, I am satisfied that the prosecution has established a prima facie case against the two accused persons,'' Justice Kavedza stated.
''I hereby place the second accused and the third accused on their defence,'' the judge added.
Two other suspects linked to the Dusit tragedy died on the day of the attack. One was killed by police, while the other detonated himself in a suicide bombing incident.
Two years ago, the US, through former Ambassador to Kenya Meg Whitman, announced a Ksh1.2 billion (USD 10 million) reward for information on the perpetrators of the deadly terrorist attack.
