Three advocates have been suspended from the Roll of Advocates following disciplinary action for professional misconduct.
According to a Gazette notice dated October 9, the advocates were found guilty by a disciplinary tribunal and have been suspended for varying periods of time.
“PURSUANT to Section 69 (2) of the Advocates Act, Cap. 16, Laws of Kenya, it is notified for the information of the general public that final orders were made and the following Advocates were suspended from the Roll of Advocates by the Disciplinary Tribunal pursuant to orders issued in their respective Disciplinary Tribunal Cause (DTC),” notice reads
The names were published the Chief Registrar of the Judiciary, Winfridah Mokaya.
Mokaya said that the decision followed orders issued by the respective Disciplinary Tribunals of the advocates.
Following this disciplinary action, the listed advocates are prohibited from carrying out the duties of an advocate in Kenya for the duration of the suspension.
Suspended advocates cannot represent clients or appear in court anywhere in the country without the Registrar's express authority.
Advocates Struck Off
This latest suspension follows the striking off of nine lawyers from the Roll of Advocates a few years ago due to malpractice.
In 2023, former Chief Registrar of the Judiciary, Anne Amadi, ratified the Advocates Disciplinary Tribunal's recommendations by striking nine advocates off the Roll of Advocates.
The charges against the affected lawyers were not disclosed.
Another 20 lawyers were struck from the list in 2018.
Any form of professional malpractice is frowned upon by the law, including disgraceful or dishonourable conduct that is incompatible with the status of an advocate.
Complaints about such conduct can be made to a tribunal by any person.
