The High Court in Nakuru suspended the implementation of a KSh 2.1 billion roads agreement signed between the Nakuru County Government and the National Youth Service (NYS) on Wednesday, December 10, 2025.
The petitioners argue that the deal, which was set to facilitate the construction and upgrading of various roads across Nakuru, violated public procurement laws.
They argued that the agreement was entered into without a procurement process and public participation, which is a mandatory requirement for major government undertakings.
Petitioners sought to have the court issue a conservatory order suspending the county and the NYS from implementing the deal entered into on November 7, 2025.
In his ruling, Justice Julias Nangeya certified the matter as urgent and issued a conservatory order suspending the project until January 19, 2026, when the petition is scheduled for mention.
According to the court, this suspension halts any further steps toward implementing the agreement between the county administration and the NYS.
A week earlier, the county had signed an MoU to oversee maintenance of all roads under the Imarisha Barabara Programme.
The Imarisha Barabara Program (Strengthen the Roads Program) is an infrastructure initiative by the Nakuru County Government in Kenya, led by Governor Susan Kihika
Its focus is on repairing, grading, graveling, and maintaining rural and feeder roads to enhance mobility and spur economic growth in areas including Rongai, Naivasha, and Molo.
The case will proceed to a full hearing, where the court will examine whether the procurement process met constitutional and legal requirements.
