High Court Blocks IEBC's Plan to Delete Embu Gubernatorial Candidate Kithinji Kiragu From Ballot Papers

The High Court on Thursday blocked the Independent Electoral and Boundaries Commission (IEBC) from deleting the name of an Embu gubernatorial aspirant on election ballot papers.

Party of National Unity (PNU) candidate Kithinji Kiragu had moved to court to bar the IEBC after the Court of Appeal ruled that his nomination had not followed proper procedures.

The IEBC, on August 2, announced plans to delete his name from the ballot papers and have them re-printed ahead of the Tuesday polls.

Justice Msagha Mbogholi ordered the IEBC to cancel the plans in a ruling passed at the court's Judicial Review Division.

Mr Mbogholi directed the applicant to serve IEBC and PNU, named as respondent and interested party respectively, and file a substantive motion within 21 days.

The period given by the courts will be well past the election date, therefore, the candidate has a chance to battle it out for the county's top seat.

Mr Kiragu was initially in the Jubilee party and lost to incumbent Governor Martin Wambora during the party nominations.

In June, he, alongside his running-mate Mr Elias Kathiga led 17 others in defecting from the Jubilee party citing interference in Embu politics from the party headquarters.

Mr Kiragu will battle it out with Wambora, Senator Lenny Kivuti of Maendeleo Chap Chap, Leonard Muriuki of NARC Kenya, Dr Njagi Kumantha of the Democratic Party and Dr Cyrus Njiru an Independent Candidate
