Businessman Jimmy Wanjigi has been sued by a helicopter charter service firm which is seeking orders to bar him from taking possession of his chopper – registration number 5Y-JWJ – for failing to settle a Sh16.5 Milion debt in maintenance and hangar fees.
The firm, Lady Lori, filed a case seeking orders to bar Wanjigi and his companies – Tyl Limited and Kwacha Group of Companies – from taking back their aircraft without settling the debt that has accumulated since 2015.
The helicopter charter service provider stated that it was contacted by Mr Wanjigi and the two firms in 2014 to service the chopper and provide Wanjigi with one of his helicopters when his was not working.
“Lady Lori was approached by Tyl Limited to maintain its helicopter 5Y-JWJ to which Lady Lori agreed. Further to an oral aircraft agreement, Tyl Limited requested Lady Lori to place its helicopters at the disposal of Jimmy Wanjigi at all times when its helicopter shall be under maintenance and not airworthy.
“But Tyl Limited in a clear and elaborate mischief has chosen to disown its contractual obligations relating to the maintenance and charter agreements and only seeks to honour the hangar agreement. Which it is also disputing in a bid to avoi8d paying the full outstanding amounts,” the suit papers by Lady Lori read.
Tyl limited, however, filed an objection to the suit arguing the case was filed to blackmail it into paying debts owed by Wanjigi and Kwacha group of companies.
The company claimed that the helicopter has not been operational for more than two years, dismissing claims that it was used by the National Super Alliance (NASA) Leader Raila Odinga during campaigns.
Mr Wanjigi and Kwacha Group of Companies are yet to respond to the suit.
