The Caucus of women candidates has moved to court to stop the swearing in of all nominated Members of Parliament (MPs) and Members of County Assembly (MCAs).
The women delegates claim that the parties compiled the list of nominees unlawfully.
The case was filed on Wednesday as the MPs were scheduled for swearing in on Thursday.
National Super Alliance (NASA) parliamentarians who had earlier threatened to boycott the first session of the 12th Parliament surprisingly abandoned the plan.
Bungoma Senator-elect Moses Wetangula on Wednesday stated that the leaders of the Opposition wing had unanimously decided to attend the inaugural session.
Mr Wetangula, however, emphasised that the MPs and the Senators would only be in the house for the purpose of taking the oath of office.

Nairobi MCAs are set to be sworn in on the first week of September while their counterparts in other counties have already taken the oath.
