Supreme Court Registrar Esther Nyaiyaki has revealed that the audit of Forms 34A, 34B and 34C yielded a number of controversial details.
In a report, Ms Nyaiyaki outlined that the Form 34C that Independent Electoral and Boundaries Chairman Wafula Chebukati used to declare President Uhuru Kenyatta as the presidential election winner had missing details.
According to the Registrar, the form lacked security features as well as a serial number.
"The form looked like a photocopy," Ms Nyaiyaki stated in the report submitted to Supreme Court judges.
President Kenyatta's agents also inspected the forms and observed that the Form 34C was indeed a photocopy.
The IEBC on Tuesday availed 41,451 Forms 34A for inspection as well as 291 Forms 34B and one Form 34C.
The court Registrar observed that some of the Forms 34A submitted by the IEBC were not original copies but carbon copies while some others did not bear the IEBC rubber stamp.
"236 out of the 291 Forms 34B inspected were found to be missing watermarks while 56 of the forms did not have security features," Nyaiyaki's report outlined.
The report adds that only 31 forms did not have a serial number and 32 others were not signed by the agents.
A random check by the team indiscriminately assessed 4,120 forms from 32 constituencies and found that 189 did not have hand-over notes while 287 had no take-over notes. Of those, only 103 Forms 34B had the notes.
IEBC lawyers had explained to the court that the missing notes were not necessary because the forms were being scanned and sent electronically to the returning officers in the constituencies and the National Tallying Cente.
