The Jubilee party has been enjoined in a case by three voters seeking to stop the IEBC from conducting the October 17 Presidential election as currently constituted.
It is still unclear whether the ruling party will support or oppose the petition.
On September 1st, 2017, three voters filed an urgent petition seeking to stop IEBC Chief Executive Ezra Chiloba and the electoral body commissioners from overseeing the repeat presidential election.
Mr Brian Asin, Mr Ben Wanasakaami, and Mr Kevin Alwang’a sued Mr Chiloba, Mr Wafula Chebukati (chairman), Ms Consolata Nkatha (vice chairman), and Commissioners Roselyn Akombe, Prof Abdi Guliye, Margaret Mwachanya, Paul Kurgat, and Boya Molu.
The petitioners want the High Court to bar the team from supervising, overseeing elections in the country and in particular the repeat of the presidential election.
They argued that the integrity of the IEBC officials to hold credible elections is in question and asked the court to declare that the eight top IEBC officials lack the obligatory qualifications to exercise public authority.
"A declaration that a person having been mismanaging the presidential election and in particular the 1st to 8th respondents shall not qualify to hold a public /state office," their petition read in part.
The Attorney General and IEBC have also been named as respondents in the case.
