Court Issues New Order in Petition Against Aden Duale's Re-election

The High Court has ordered Garissa Township Member of Parliament (MP) Aden Duale to respond to an election petition filed by former Deputy Speaker Farah Maalim within seven days.

Election Court Judge Hedwig On'gundi on Wednesday ordered the National Assembly Majority leader and the Independent Electoral and Boundaries Commission (IEBC) to respond to the petitioner's case.

Farah Maalim, through lawyer Chahilu Edwin, filed an election petition last month seeking to overturn the National Assembly Majority Leader's win claiming that the election was flawed with irregularities.

In his petition, Mr Maalim claimed that Duale's supporters were allowed to vote more than twice.

He further alleged that the IEBC officials did not mark the voters with indelible ink after they were presented with IDs during voting.

"This was a violation of the election laws, there were long delays deliberately created to discourage my supporters, he noted.

He, therefore, wants the court to declare that Duale and IEBC jointly committed election irregularities.

Maalim, who was the Orange Democratic Movement (ODM) parliamentary candidate, also sought an order to secure the election materials used by IEBC to conduct  Garissa South constituency elections on August 8th.

The court will hear the full application on 3rd October once all parties have responded.
