New Twist Emerges on Case About Supreme Court Judges Secretly Meeting NASA Team

A Mombasa-based NGO, Angaza Empowerment Network, has disowned the petition filed against Supreme Court Judges Philomena Mwilu and Justice Isaac Lenaola by its CEO Derrick Ngumu.

The lobby group has disassociated itself from its CEO, who petitioned the Judicial Service Commission (JSC) to dismiss Justice Lenaola and Deputy Chief Justice Philomena Mwilu for gross misconduct.

Mr Ngumu also appealed to have the ruling which nullified President Uhuru Kenyatta's election overturned by the Supreme Court.

The Company's Executive Director, Livingstone Nyando, faulted the CEO for not consulting the members of the board before making the huge step to file the petition.

He indicated that for such kind of a decision to be reached, a board meeting ought to have been convened to discuss the matter where the majority decision should have prevailed.

"In this case, at least three of the directors must admit to the proposal before ratification. No board meeting was held for that matter," he said

The five directors of the company also indicated that the petitioner is not actively involved in the organisation's operations and did not involve other stakeholders of the company.

Mr Nyando affirmed that there were no minutes of a meeting that could have directed the petitioner to file the election case On that account, he noted that they would write to the JSC to exclude the NGO from the petition.

In the petition, Mr Ngumu alleged that Mwilu and Lenaola were in secret communication with NASA lawyers during the entire period of the Presidential election petition hearing.

The Deputy Chief Justice was accused of having had telephone conversations and meetings with Raila's lead counsel James Orengo, Senators Amos Wako and Moses Wetangulawho were all directly linked to the case.  

On his part, Justice Lenaola was alleged to have had interactions outside the courtroom with the legal representative of the Law Society of Kenya Steve Mwenesi.
