High Court Issues 1st Directive on NASA’s Presidential Election Boycott

The High Court has directed that National Super Alliance (NASA) leaders be served with suit papers in the case seeking to stop them from boycotting the October 26 presidential election.

Justice Chacha Mwita directed Pokot MP David Pkosing to immediately serve Raila Odinga, Kalonzo Musyoka, Musalia Mudavadi and Moses Wetang'ula with the suit papers.

The four had been sued alongside IEBC Chairman Wafula Chebukati, the Registrar of Political Parties and the Attorney General.

"Let the petitioner file and serve respondents with the suit papers and parties come back for further directions on October 9," Mwita stated.

On Monday Mr Pkosing filed a case challenging the declaration by NASA leaders that there will be no election on October 26th if their demands on electoral reforms are not met.

Pkosing accused NASA of having an elaborate plan to intimidate voters and ensure no elections are carried out in a number of their strongholds.

The MP further claimed that the Opposition was also planning to challenge the validity of the entire election.

He asked the court to declare that any action by Odinga, Musyoka or any of the NASA principal to stop the repeat presidential election an act of treason to which they should be held accountable.

NASA, among other things, have demanded the resignation of IEBC CEO Ezra Chiloba and the blacklisting of two companies they accuse of bungling the August polls; Paris-based IDEMIA (formerly OT-Morpho) and Dubai-based Al Ghurair Printing firm.

The Opposition has also given the electoral agency a list of irreducible minimums which they say must be met before the repeat poll is held.
