High Court Makes New Decision in Presidential Candidate's Case

The High Court has suspended a bankruptcy notice issued against Cyrus Jirongo, a candidate in the upcoming October 26th Presidential election.

Making the ruling on Monday morning, the court directed his lawyers to file a defence within the next two weeks.

Jirongo was declared bankrupt by a commercial court on October 10th after failing to service a debt running into hundreds of millions of shillings.

His assets were to be put under the receivership of a trustee who has legal rights to auction them so as to pay the debt.

Commercial Court Judge Olga Sewe declared Mr Jirongo bankrupt due to his inability to pay businessman Sammy Boit arap Kogo a Sh700 million debt.

In the nullified August 8th election, Jirongo ran on a United Democratic Party (UDP) ticket and garnered 11,000 votes.

Mr Jirongo had earlier pledged to support Jubilee Party candidate President Uhuru Kenyatta in the October 26th poll.

In a different case, the High Court had found the former Lugari MP liable to pay a Sh110 Million debt to Central Organisation of Trade Unions (COTU) Secretary-General Francis Atwoli.

In the case, the Court ruled that the trade union boss had the right to enforce payment of the debt, which Mr Atwoli stated was a 'friendly loan'.

Jirongo pleaded with the court to wait for the Nairobi County Government to pay a debt it owed one of his companies, Kuza Farms and Allied Ltd, before he could repay Atwoli's loan.
