ODM Files New Case to Kick Aukot Out of Presidential Race

The Orange Democratic Movement (ODM) has filed a case against the inclusion of Thirdway Alliance Presidential candidate Dr Ekuru Aukot in the repeat presidential election.

This follows the withdrawal of a similar case by blogger Abraham Mutai, who had challenged the inclusion of Aukot in the poll.

Prior to the withdrawal on Thursday, there was controversy after two law firms fought over his representation at the Court of Appeal in Nairobi.

Lawyer Nelson Havi, who filed the appeal, had told judges Alnashir Visram, Wanjiru Karanja and Martha Koome that he was still acting on behalf of Mr Mutai and was ready to proceed.

However, lawyers Anthony Gitonga and Evans Lagat claimed they had instructions to represent Mr Mutai and withdraw the appeal.

This saw Mr Havi sensationally claim that the Jubilee Party, which benefited from Mr Aukot’s case after National Super Alliance (NASA) leader Raila Odinga pulled out of the election, had coerced the petitioner to drop the matter.

Lawyer Havi alleged that Jubilee had promised Mr Mutai Sh7 Million if he withdrew the case.

President Uhuru Kenyatta’s party, through lawyer Tom Macharia, termed Mr Havi’s allegations as “buffoonery and playing to the gallery”.

The judges later ruled that Mr Gitonga and Mr Lagat were on record for Mr Mutai after which they divulged that they had been instructed to withdraw the case.

Last week, Aukot hit out at the Opposition leader noting the former Prime Minister represents past politics and such should be routed out for the good of the country.

Dr Aukot added that he does not care what the NASA leader thinks of him and vowed to participate in the fresh poll.
