Supreme Court Throws Out Election Petition

The Supreme Court has rejected a case filed to reverse the nullification of the August 8 presidential election in September.

Justice Isaac Lenaola dismissed the petition filed by Jackson Ndegwa and Edward Kings stating that they were strangers to the issues before the court.

Lenaola noted that while the Judicial system recognises the rights to a fair hearing, access to justice and fair administrative action, the same cannot be enjoyed in a procedural vacuum.

The case was initially rejected by Deputy Registrar Daniel ole Keiwua after Ndegwa and Kings appeared before him on September 18.

"The applicants are strangers to the petition which they seek to void. Unless they had been properly enjoined to it, their patriotic attempt at invalidating the petition and voiding its judgement must fail," Justice Lenaola stated.

"The decision of the deputy registrar, rejecting the applicant's notice of motion, is hereby affirmed," he added.

In their petition, the duo had asked the court to overturn the judgement claiming that it originated from flawed and incompetent proceedings.

They further argued that the petition filed by NASA leaders Raila Odinga and running mate Kalonzo Musyoka was invalid since it failed to comply with section 35 of the Advocates Act.

Ndegwa and Kings also told the court that the repeat poll held on October 26 was a huge burden to an already battered economy.

The two noted that the Sh12 Billion set aside for the presidential re-run could have been channeled to other projects such as education and health.
