4 Major Errors Discovered In Jaguar's Election Case

Four serious anomalies have been identified by a researcher in an election petition case filed by Steve Mbogo challenging the election of Charles 'Jaguar' Kanyi as MP for Starehe Constituency in the August 8th election.

The researcher, Mr Nyangasi Oduor, told the court that he had found serious anomalies in 160 out of 182 forms 35A.

First, he stated that a large number of the forms did not bear the official Independent Electoral and Boundaries Commission (IEBC) stamp.

The court was also told how many forms lacked the signatures of the Presiding officer and the Deputy Presiding Officer.

Furthermore, Oduor alleged that ballot boxes had been stuffed.

He specifically cited St Peter's Clavers Polling Station where 16 Forms 35A lacked official stamps.

Finally, Justice Fred Ochieng' was told of an inexplicable variation between the declared results in the parliamentary election and the actual results tallied by the electoral body.

Oduor noted that Forms 34B in Nairobi Central Ward had a total of 34,585 votes cast yet the Form 35B showed votes cast were 38,036.

The electoral body was ordered to file Forms 35A and 35B for Starehe Constituency.

The court also ordered the electoral body to release all memory cards from the Kenya Integrated Election Management System (KIEMS) to the Deputy Registrar Elizabeth Tanui.

Steve Mbogo, who wants the election to be nullified, is expected in court on Tuesday for cross-examination.
